Semapa – Sociedade de Investimento e Gestão, SGPS, S.A. (“Semapa“) guarantees visitors to this Website (“User” or “Users”) respect for their privacy, as well as the protection and security of their personal data, in its capacity as data controller.  

 Visiting the www.Semapa.pt website (“Website”) does not in itself imply the automatic recording of any personal data identifying the User. However, the use of certain functionalities may imply that Users provide personal data.  

This Privacy Policy forms an integral part of the Website’s Terms of Use and regulates the collection, processing and protection of Users’ personal data collected and processed in connection with its use.  

Users are requested to read this Privacy Policy so that they can freely, informedly and voluntarily decide whether they wish to provide Semapa with their personal data.  

 The User guarantees that he/she is of legal age and that the data provided is true, accurate, complete and up-to-date, and is responsible for any damage or loss, direct or indirect, that may result from failure to fulfil this obligation. If the data provided belongs to a third party, the User guarantees that they have informed the third party of the information contained in this document and obtained their authorisation to transfer the data to Semapa for the purposes identified. 

 Purposes of Processing and Legal Basis 

Semapa will process your data manually and/or automatically for the specific purpose of Contact Management:

  • Personal data: identification data, contact data, the message you have sent and any data you have provided;
  • Purpose: answering questions, requests and providing information;
  • Basis: Semapa legitimate interest in guaranteeing a response to any request for information from Users;
  • Retention period: for the period necessary to respond to your request.  

Data Communication 

 Semapa may communicate your personal data to third parties provided that it has unequivocally obtained the consent of the Users or when:  

  • the communication is carried out as part of the fulfilment of a legal obligation or court order;
  • the communication is carried out to protect the Users’ vital interests or any other legitimate purpose provided for by law. 

 Subcontrators 

User data may be processed by a suitable service provider contracted by Semapa. This service provider will process the data only for the purposes established by Semapa and following its precise instructions, strictly complying with the legal standards on personal data protection, information security and other applicable legislation.  

International Data Transfer 

Semapa will process User data within the European Economic Area. However, in certain cases, it may carry out international transfers to fulfil applicable legal obligations or in cases where this is necessary for contracting a service, provided that the third country ensures an adequate level of personal data protection in accordance with the guidelines and agreements concluded with the European Union. 

 Retention Periods

 The personal data collected will be kept for the period necessary to fulfil the processing purposes described above, after which it will be definitively deleted, without prejudice to the existence of a legal obligation on the part of the controller to keep personal data for an additional period. 

 User Rights 

 Users may, at any time and free of charge, exercise their rights to access, update, rectify or erase, oppose, limit and port their personal data.   

Users are also guaranteed the right to withdraw their consent to the processing of personal data for the respective purposes, where applicable, although this does not invalidate the processing carried out up to that date on the basis of the consent previously given.  

 In order to exercise any of the aforementioned rights, the User must submit a written request via the email address dpo.@Semapa.pt, or by sending a letter to the address Av. Fontes Pereira de Melo, n.º 14, 10.º andar, 1050-121 Lisboa. 

In any case, the User is informed that, if it is considered that Semapa has violated, or may violate, the rights recognised by the legislation on the protection of personal data, the User may submit a complaint to the National Data Protection Commission (CNPD) via the telephone number +351 213 928 400 or the e-mail address geral@cnpd.pt. 

 Automated Decisions

Semapa may draw up User profiles, which will allow automated decisions to be made based on personal, economic and/or financial characteristics. In these cases, the User will have the right to obtain human intervention in the decision, to express their opinion and to challenge the decision adopted by Semapa. 

 Personal Data Protection Measures 

Semapa makes every effort to protect Users personal data from unauthorised access via the Internet. To this end, it uses security systems, rules and other procedures to guarantee the protection of Users’ personal data, as well as to prevent unauthorised access to the data, its improper use, disclosure, loss or destruction.   

 It is, however, the User’s responsibility to guarantee and ensure that the computer they are using is adequately protected against harmful software, computer viruses and worms. In addition, you should be aware that without the adoption of appropriate security measures (e.g. secure browser configuration, up-to-date antivirus software, security barrier software and not using software of dubious origin), the risk of personal data and passwords being accessed by unauthorised third parties is increased.  

 It should be noted that whenever data is collected on open networks, such as the Internet, your data may circulate without security conditions and there is a risk that it will be seen and used by unauthorised third parties.

Semapa reserves the right, at any time, without prior notice and with immediate effect, to amend, add to or revoke, in part or in full, this Privacy Policy. Any changes will be immediately publicised on this same online page, so we advise you to check this page regularly to keep up to date.
